We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these terms of use.

If you know or suspect that anyone other than you knows your user identification code or password, you must promptly notify us.

Selling on our site

We aim to provide an effective platform for you to list digital currency for sale (“Seller”) or to buy such digital currency (“Buyer”) - we make our services available through our website, mobile applications, and other platforms. However, we are not acting as agent of the Seller. Our aim is to provide a favourable experience for both our Sellers and Buyers.

If you are a Seller offering digital currency for sale you shall:

• post a description of the digital currency offered and set a price. Sellers are solely responsible for the description, price and authenticity of the digital currency offered;
• represent and warrant that you hold good title and are free to sell the digital currency offered and that the sale to any Buyer will be free of any charges or encumbrances.

Buying on our Site

If you are a Buyer buying digital currency with fiat currency, it is your sole responsibility as Buyer to arrange a suitable payment method with the Seller. We accept no liability for any losses arising as a result of any method of payment agreed between the Buyer and Seller. The Buyer shall, if required by us, be ready to prove his identity, when buying digital currency online.

Uploading content to our site

Whenever you make use of a feature that allows you to upload content to our site, or to make contact with other users of our site, you must comply with the content standards set out in our Acceptable Use Policy.

You warrant that any such contribution does comply with those standards, and you will be liable to us and indemnify us for any breach of that warranty. If you are a consumer user, this means you will be responsible for any loss or damage we suffer as a result of your breach of warranty.

Any content you upload to our site will be considered non-confidential and non-proprietary. You retain all of your ownership rights in your content, but you are required to grant us and other users of the site a limited licence to use, store and copy that content and to distribute and make it available to third parties. Rights you licence

When you upload or post content or submit material to our site, you grant to us a perpetual, worldwide, non-exclusive, royalty-free, transferable licence to use, reproduce, modify, distribute and display that content or material in connection with the service provided by the site and across different media and for the purposes of marketing and promotion of the site and xcoins Incorporated. You represent and warrant that you own or otherwise control all of the rights to the content that you upload or post.

Our fees

The Seller shall pay to us a transaction fee (“Transaction Fee”) at the rate displayed on www.xcoins.exchange, as amended from time to time, such sum shall be deducted from the amount of digital currency being held in the escrow service at the time the Seller completes the transaction by clicking the appropriate button to finalise the trade .

Verifications

The xcoins platform, has the right to require its additional documentation, it may require other guarantees as part, National Identification, document Residence, Selfie or Request a deposit

The minimunm amount to trade without verification is $10.000 USD per trade.

Purchasing

If you are a Buyer you acknowledge that:

• It is your responsibility to determine the value, and authenticity of the digital currency.
• Your contract to purchase is with the Seller and not with xcoins Incorporated. You and the Seller will be responsible for the obligations of the contract and we exclude all liability arising from the purchase or sale contract.

Buyers making an offer for the purchase of digital currency on the site represent and warrant by placing any offer that they are ready, willing and able to pay the full purchase price within 24 hours of making such an offer.

Upon acceptance of the Buyer’s offer to purchase by the Seller, we shall separately confirm the agreement to the Seller and notify the Buyer submitting the offer that the offer was successful.

If there is no contact or payment from the Buyer to the Seller within 24 hours of the offer being successful, the Seller may contact our support team and we reserve the right to abort the transaction.

Whilst the digital currency remains in the escrow service, the Buyer may abort the transaction at any time.

Escrow

When a Buyer's offer is confirmed by the Seller, the specified amount of the digital currency the Buyer wishes to buy (which includes the transaction fee payable to us) is held locked on our escrow service. After the Seller confirms the buy request, the digital currency specified is reserved from the wallet of the Seller and put into escrow. The digital currency will not be released by us until the Seller completes the transaction by clicking the appropriate button on the website to finalise the trade.

When a Seller's offer is confirmed by the Buyer, the specified amount of the digital currency the Seller wishes to sell (which includes the Transaction Fee) is reserved from the wallet of the Seller and put into escrow. The digital currency will not be released by us to the Buyer until the Seller completes the transaction by clicking the appropriate button to finalise the trade.After a trade is initiated but prior to completion of the trade, if there has been no activity for 24 hours by either the Buyer or the Seller, we reserve the right to abort or release the transaction. If a transaction is aborted or released, all funds held in escrow relating to the aborted transaction shall be released to the Seller or Buyer.

Disputes

Any dispute with respect to the sale shall be resolved between the Buyer and Seller and without the participation of xcoins Incorporated. The Seller is solely responsible for collecting payment from the Buyer. xcoins Incorporated does not guarantee and is not responsible in any way for the performance or non-performance of Buyers or Sellers using the site.

We reserve the right to release a transaction from escrow to either Buyer or Seller if there is substantial evidence by governmental, executive or legislative authorities, which indicate that the transaction has to be released to one of the parties.

Intellectual property rights

We are the owner or the licensee of all intellectual property rights in our site, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.

You may print off one copy, and may download extracts, of any page(s) from our site for your personal use and you may draw the attention of others within your organisation to content posted on our site.

You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.
